January 1, White House Confirms First Name on Shortlist for Breyer’s Replacement
The White House confirmed that South Carolina federal Judge J. Michelle Childs is “among multiple individuals under consideration” to replace retiring Supreme Court Justice Stephen Breyer.
“Judge Childs is among multiple individuals under consideration for the Supreme Court, and we are not going to move her nomination on the Court of Appeals while the President is considering her for this vacancy,” White House spokesman Andrew Bates said in a statement.
The Biden administration’s acknowledgment comes after Democratic House Majority Whip Jim Clyburn said that at least two GOP senators see Childs as Biden’s best bet.
One Republican senator went public with his support of Childs.
“I can’t think of a better person for President Biden to consider to the Supreme Court than Michelle Childs,” Sen. Lindsey Graham (R-S.C.) told CBS’s Face The Nation.
“Affirmative action is picking somebody not as well qualified for past wrongs. Michelle Childs is incredibly qualified. There is no affirmative action component if you pick her.”
Biden has received criticism for saying that he will nominate a Black woman as Breyer’s replacement, with detractors saying race and gender shouldn’t be determining factors.
“Biden chose Harris as his VP because of the color of her skin and sex—not qualification. She’s been a disaster,” former Rep. Tulsi Gabbard (D-HI) tweeted.
“Now he promises to choose Supreme Court nominee on the same criteria. Identity politics is destroying our country.”

I think that is racist. He should choose who is best qualified. It is unconstitutional to chose someone, according to the constitution, with Religous beliefs, sex or race. He is breaking all constutional law. From the border crisis right on down the judge on the supreme court. This President needs to be impeached for not protecting and defending our Constitution as per vow as President of the United States, putting this great nation in grave danger.
